The concept and explanation of Industrial design.
1. Concept:
Industrial design is the appearance of the product, expressed in lines, shapes, colors, or a combination among these factors.
Products with the Industrial design, is understood as objects, tools, equipment, vehicles ... in all fields, having a certain structure and functions and being produced and circulated independently.
2. Conditions of protection: Industrial designs
are protected only if they fill all the following conditions:
- Having
new features in the world, it means that they never disclosed publicly in any places in the world, under the form of publication or use.
- Having
the creativity, it means that those Industrial designs cannot create easily for people with average knowledge in their respective fields.
- Having
the capable of industrial application, it means that they have the capable of modeling used to produce series of products repeatedly by
industrial method or
handicraft method.
3. Objects is not protected with industrial designs: - The external appearance of the product being created easily for the average person qualified in their respective fields, for example:
- The external appearance with the technical characteristics of the product which requires technical characteristics forcedly or just has technical characteristics only;
- The external appearance of the product being invisible during using;
- The external appearance having aesthetic value only (not used as a sample to produce industrial products or handicraft ones);
- The external appearance of the civil building construction or industrial one;
- The objects contrary to the social interest, public order, humanitarian principles.
