Vietnam lacks of the enforcement mechanism of administrative
“During the course of legal consultancy for organizations and individuals, the lawyers see that the claims on administrative decisions and behaviours of competent authorities take a long time to be settled. Even though the judgment is effective in favor of the Claimant, the competent authorities are requested to voluntarily enforce the decision of the court.
However, if the competent authorities do not revoke their administrative decisions and behaviors as requested, we still lack the mechanism to obligate them. Nowadays, there is only existing enforcement mechanism of civil judgment. Thus, this is the barrier preventing the citizens from following the legal enforcement of competent authorities”
The mentioned-above speech was presented by Lawyer Nguyen Thanh Ha in the Conference on Research on the role of social organizations and individuals in legal enforcement compliance on May 10, 2013 of Ministry of Justice under the project 58492 “Improvement and protection of justice and right in Vietnam” of United Nations.
